retainage problem

I hope someone can help here, I worked on a job for 19 mo's . he held 3000.00 retainer. he is now broke and spent all of our retainer that he held. He will be getting back all of his, but it is only 1/3 of what he held on us. And he is now filing chapter 7. any chance here? In total he held about 9000.00 on us and he is getting back 5000.00
