Overtime Class Action Lawsuit against ORIUS

A Federal class action lawsuit has been filed against ORIUS and it's subsidiary companies for failing to pay overtime to piecework production employees, and hourly employees throughout the United States. (Including failing to pay for travel back to the shop, unloading, restocking, and maintenance)

Please contact our law office at 1-800-882-8351 or E-Mail us at (-REDACTED-) if you worked for Orius (or a subsidiary) within the last 3 years and were not paid time and 1/2 (overtime)when you worked over 40 hours in any work week.

Federal law provides the following: (From the DOL Website)

"Piece rate -- The regular rate of pay for an employee paid on a piecework basis is obtained by dividing the total weekly earnings by the total number of hours worked in that week. The employee is entitled to an additional one-half times this regular rate for each hour over 40, plus the full piecework earnings.

Example: An employee paid on a piecework basis works 45 hours in a week and earns $315. The regular rate of pay for that week is $315 divided by 45, or $7.00 an hour. In addition to the straight-time pay, the employee is also entitled to $3.50 (half the regular rate) for each hour over 40 -- an additional $17.50 for the 5 overtime hours -- for a total of $332.50."

You must contact our office and "opt-in" to this lawsuit to participate in any future recovery in this class action. Timing is critical. Recovery may be limited to 3 years back from the date you opt in.
