How many of you would/have.......


....sign(ed) a Sub-Contract that says the Sub-Contractor (you) won't get paid if the Owner (Cable, Telephone, Internet company) does not pay the Contractor.  It is in a lot of Contracts I have read over the years, some as many as three (3) times.  I have refused to sign even one that has that language in it.  I look at it this way, I am working directly for the Contractor not the Owner.  It is unreasonable and ill-advised but legal if you sign the Contract.  Some are willing to revise and others are reluctant to revise the Contract.  

My point is that the Contracts must be read and understood before you sign them.  And don't simply sign them just to get the work. Contracts must be good for both parties, not just the one or the other.  I was often able to convince the Contractor to revise the Contract by simply asking if they would sign it as a Sub?  Most said they would not sign it and revised it. Others were arrogant about it and would not change a word.  So I refused to sign.  Their loss, not mine.

BTW Im not an attorney so this is not legal advise, just my observations of 30 some years of reading and signing or rejecting Contracts.
