1099 means you are NOT an employee, you have no ties to the company, your are not daily controlled by the company, you establish your own start and end working hrs. However you must follow the sch'd as set forth for the project such as when to turn in your progress reports, when to pick up materials. If you work alone..you might get away from have full blown liability insurance. Basically you must follow the same rules as the prime contractor, the only exception is your working hrs, the company can not control those hours. You can also work on units however your pay must meet min pay scale for the 40 hr work week. Just become an LCC..it's cheap, it legally protects you. I always say this industry will go back to strictly hourly wages..no more units. The government is getting screwed out of taxes, your screwed in later years when you have not paid into Social Security.
