This would mean in laymans terms if you are a prime contractor than all of your techs have to be W-2 employees. Some areas let you use what is called a supersub. Meaning that you have a group of techs that work for another company and you pay that company and they pay their techs. That supersub would be a 1099 subcontractor under their contract.
Most of the MSO's want you to be a contract partner but tell you what you can and can't do. They consider you as a 1099 prime contractor ... but want you to only have W-2 employees in the field. this has put a huge strain on their bottom line.
They over reach the leagl definition of 1099 laws... look it up not legal to tell you who are how you hire ..ie w-2 or 1099 it is up to you as a contractor to use what ever means as possible to get the job done as long as the work is up to spec's what does it matter if the tech is 1099 or w-2 ??? It is a over reach by the MSO to control the prime.
I'm so thankful I got out of the CATV business. Techs are making less now then in 1996 thats a huge issue with what they want from the tech in the field. But someone keeps doing the work for less and less every year .... get out if you can and good luck !!!
