The time it is held against you varies by state. With a DUI in Cal, the police agency has up to a year to file with the courts. The courts have up to two years after sentencing to process and give it to DMV. DMV has another year to process and post the points against the driving record, which are held for seven years for insurance reporting. So it can take up to 11 years after the arrest to drop from the driving record. Posession never goes away without a court order for expungment. Most of the police and court systems here operate faster than that, but if you pissed people off they can run the clock down to the end. Like Joe said, do your own check and make sure that DUI has really dropped off.
