Re: No per diem on a prevailing wage (Simulus) Pro


I have been unable to discover where the employer must pay road expenses. I did, however, get an insight into how some employers operate. After an out of town project was  shut down for the winter the work (built up roofing) delayed for four months so I applied for unemployment. 

Part of my statement was that the employer did not pay travel expenses and in the absence of daily work I returned to my home address and applied for unemployment benefits.

The employer stated, in an attempt to deny my benefits that..."the wage for the job is the state legal minimum...all other money is paid to allow the employee to find lodging near the job site...."

It is a jungle out there!

You have to assume that you are sent on the road because your services cannot be found locally and the company will benefit enough from your presence to pay for your expenses on the road. If they won't that tells you something.
