If in fact this guy is repeatedly sending out loaners to multiple customers rather than what they actually paid for, and none of those customers initially received the units they paid for, this is considered fraud and theft by deception. Considering what the cost on a decent fusion splicer is this would quickly add up to a class C or B felony depending on local laws in his area, and if he conducted business on the internet at all it becomes federal. If you guys band together and alert local authorities first you might get a speedier resolution rather than filing it in a civil claims court.
Oh also it sounds as if he's taking peoples money and then buying the machines on ebay and telling you he's making sure the machines ready before shipping it out.
