I sent the below email asking some of the same questions and got this reply. The fact that they replied almost floored me. I did remove the name of the company but he needs to use spell check..
If I am supplying all the tools, insurance and a vehicle how can I not be a Sub? I don't know of any company that makes their employees carry their own insurance. Can you answer this for me.
Their reply:
Well the insurance I'm refering to was for just legal for the state of PA for your vehicle. ########### hires full time and with in the guide lines of the IRS you will only be working for me so we will take out taxes on W-2. All my guy's currently right of thier milage and tools as needed per year. we cover all libility and workers comp. and have a policy to pertect our clilante and us for non own auto. you would need only proof or auto insurance. hope this helps to explain and also we will not hire subs.
