Every state is different on that one. There is a general rule that you cannot sign away or contract out your constitutional rights. But penalty clauses can and are built into contracts.
I had considered hitting my insurance carrier for back charges that exceeded costs...my agent said sure...but expect an increase.
The real question is why do we continue to do this crap?
