If you’re putting your experience subs through a training class, you don't have to pay. But they also have the option to not go. If they are true independent contractors, they have the decision. But that’s when you throw it back in there lap and say well if you want to keep contracting with our company you will attend....
If you’re bringing in guys off the streets and training them, they are not true subcontractors.
IRS defines a "True Independent Contractor" has the experience to go out on his/her own and do their job. You can find that on their website under Independent Contractors.
Good Luck, you just have to watch how you word everything and make sure they understand. It would also be good to watch how you document everything.
