OSHA Regulation 1903.7 c       Compliance Safety and Health Officers shall comply with all employer safety and health rules and practices at the establishment being inspected, and they shall wear and use appropriate protective clothing and equipment during inspection. That may not help your case, but it should get him in trouble.        Also a few years back if you were self employed with no employees they couldn't touch you. That may have changed. I'm not sure, I'll check, and get back to you.
