he can look all he wants,,if the company does not take out taxes and gives him a 1099 he is not an employee,,thats as..simple as it gets,,if you want to get into the legalities of it all and employer is not required to tax anyone,,it is the employees responsibility to pay his taxes,,its just easier for companies records to do it this way...........
