I don't see the problem. Are there no storage loops in the fiber? I've moved many a ped and riser, and have had to de-lash and lash as far back as 10 spans to get slack. Not a big deal. Sounds like it's only a foot or so.  Get er done. I suggest you work with the land owner and keep the lawyers out of it. Although now that I think about it , if your ped is in line with the overhead power and phone there is an easement. Sometimes you can solve the problem by setting a rock ped , and/or giving them 6 months free cable.
