Under common law you are responsible for polluting your neighbors land.  We no longer operate under common law.  We operate under commercial code and statues.  Under commercial code and statues if you pollute under an amount approved by government you receive privileges of limited liability once you pay government for the privilege of doing business and get the license.  I did not create the current system so don't blame the messenger for pointing out the flaws.

Question:
If it is wrong to pollute your neighbors land why would such liability be capped?

Answer:
Because the aristocracy got tired of common law courts handing out inconsistent punitive damages and punishing their big businesses.  Big business wanted to reign in the judgment of the people and lobbied for legislation granting privileges and immunities of limited liability under regulated circumstances.

What is the present liability cap under the federal code and why is Congress trying to increase it?
