If you are told to work hours including overtime, at least you are entitled to overtime pay on the hours over 40 a week that you worked. In addition, if you are paid benefits, you are considered a full-time employee, not a 1099 contractor. Your employer is then required to pay taxes to FICA and UI worker's compensation. Go to www.overtimecases.com and study the recoveries and class action suits that they have won for numerous employees improperly paid and classified as 1099. Hope this helps.
