High Def without the box?

 Is this possible? I'm researching launching high def and we want to retransmitt in the clear but it seems its not allowed without the customer having a box? I know I can do the over the air channels but I'm interested in the other channels espn says no way and most other programmers are the same,is anybody doing this,legally?
