I think it's funny as hell.  Florida companies have earned the 1099 to W-2 rulings.  The next generation is a group of irresponsible anti-discrimination socialists and they are going to stick it to the big companies.  Unions are inevitable in Florida because the incoming generation does not have the same values as the generation that left over money.

Corporate America is going to pay the price for it's lack of vision in pursuit of the almighty immediate dollar.  Do you think some 22 year old thought up the idea to file an SS-8 or wage and hour complaint out of the blue?  Hell no... it is the older generation corporate America screwed that taught younger people to use the legal system to their advantage.  Which was ironically, lobbied for by protectionist corporate America.  The working generation said no problem we will take your less pay and shove it up your ass by teaching the legal system to the next generation instead of good work values.

There was also this case:
Nash v. Resources Inc., 982 F. Supp. 1427 (D. Or. 1997), the U.S. District Court for Oregon ruled that a cable installer was an employee rather than an independent contractor because the worker did not control his work schedule. In making its decision that the employer owed the worker back wages and liquidated damages, the Nash court also cited the employer´s ability to hire and fire the worker, to determine the worker´s wages and to issue him paychecks.
