lol.....Funny how when the new Latina Supreme court justice said something similar, the GOP had a fit. 

But yes, Common Law is made by judges.  But laws can't be changed from the bench. Common law kicks in only in instances where there is no law on the books that settle a matter.  In this case, the law is clear that insurance companies have the right to deny coverage to those with pre-existing conditions.  If I recall correctly, there is alot of case law to support their right to deny coverage.

So like I said, lawyers can't CHANGE the law.
