I learned the hard way by watching an associate get "nabbed" for having "contractors" work for him( and he was just ignorant of the rules not dirty or crooked) for about $75,000.00 in fines/fees. That convinced me that I didn't know enough to handle that side of my business and hired a small payroll company( fee is approx $25 per employee per mnth) and they told me that since my "contractors used my equipment, trailers, machines, and tools that I controlled more than 80% of their work so they were employees. They were all "hired"( even though they had worked for me 1-2 years) and even though there is extra expenses in payroll taxes and a little higher workers-comp everything is 1000% legit.
