Your wrong on the taxes, they have already been paid by the sub on the original amount
The employer would have to pay payroll taxes, and then any additional income tax would be paid by the employee. if it is a court ordered repayment plan for misclassifaction, no fees or charges would be incured, because it was not the fault of the employee. But he would still be responsible for any income tax, but that would be taken out of the lump sum payment ( if ever received) from the employer in question.
Least that how I think it would work, i could be wrong.
