Of course it is discrimination. That is what companies do. The personel department considers applicants and discriminates to hire the best suited person for the job. One criminal charge is not an impediment to employment but if all other applicants have no criminal charges they can discriminate by eliminating all applicants with any criminal background.
Now if they said all white guys leave the room and drop your applications in the can on the way out...We are going to have only African Americans in this shop....That would be racial discrimination and that is illegal.
