 The terrorists that were tried in U.S.Courts were apprehended on U.S. soil.  That's why they were tried inside U.S. borders.  That's why they were treated as criminals.  Terrorists caught outside of U.S. borders are supposed to be treated as prisoners of war.  That's where the Military Tribunals should be stepping in.
