Regardless, you shouldnt have a modem transmitting over 50, there is no call for it.  If its in an apartment complex it can get tricky sometimes.  You can always CYA by telling the customer you will not hook up a TV in that room that they will have to go buy there own splitter if they want TV in there so it is not backcharged to you.  Some systems have 26 taps and they should yank all those out of there.  If they dont want to they need to at least sweep there active with a +3 telemetry to make up for it.
