Well, when you're uninsured, hospitals are obligated to treat you. Therefore the pay to play rules still apply. I guess an alternative could be, to have all those who wish to stay un-insured, waive all their rights to be treated, or make it so healthcare tabs cant be included in BK's. Things like that I could agree with as an alternative to a tax penalty.
