wether charter did anything in reference to his work or not, if the contract states 90 days then that is the limit for them to keep retainage.  the only reason they could keep it longer would be if there was a clause in the contract to nullify that stipulation due to additional backchargesbeyond 90 days.   IMHO, if they are just QCing jobs @ or after 90 das something is wrong with the way they QC or the prime he is working for is full of it .    it really is that simple, too.
