If the technology is under patent and is being exploited by another company to make money than they are in the right. These companies are making billions off of subscribers, and TIVO is suffering since cable companies have taken over the market with DVR, making TIVO useless. The ethical thing to do would have been to negotiate a contract with TIVO from the beginning and use their equipment. I imagine that the DVR used by DISH was based off of a TIVO device through reverse engineering.
