They would never take you to court because then its too easy for you to file a counter suit. These guys dont want to set foot in a courtroom!! I would barter a deal and make sure they have $ in hand no checks because those can be cancelled.
Who is this co you are working for? Is it a connect or JP&D contractor by chance?
