A 5yo Misdemeanor .... You should be fine for employment. Hell ... a drunk'en shoving match in a bar can turn into a charge on your record. Doesn't mean your a liability. If is was ...LOTS and LOTS of folks would be flipping burgers.
As for a felony charge ... IMHO ... If it's still on your record after 10 years:
#1 - You failed to contact the state it was in and get it expunged if it was a non-violent charge. (blame yourself for not getting work)
#2 - The crime was so heinious ... It would never get expunged ever to begin with. (again... blame yourself for not getting hired)
If you have a felony over 10 years old ... start the process for getting it removed so you can get back to life.
As for the liability of it ... Can't really blame the companies for hiring those without a record. Think about it... Would you want a felon convicted of sexual assault in your house for 2 hours with your wife and daughters while your off at work?? That is the exact scenario the MSO's are sweating. A contractor employee or sub-contractor servicing hundreds or thousands of address with felons on the payroll.... Statistically, one of them is going to regress eventually. Then it's a real mess for everyone.
So leave crime to the real criminals and put the bong down long enough to piss clean.
My 2-Pennies.
