In texas, just crossing his property line or if you beleived it was your responsibility to watch over a neighbors property or to just protect property you can use deadly force. A plain clothes detective was sitting in front of the property when the shooting happened. He was waiting for uniformed police to arrive since he knew Horn was armed. Horn was not arrested at all even as all of it unfolded before the detectives very eyes speaks volumes. The DA went to a grand jury because of all of the latino activists screaming, and Horn was no billed.
As far as the being told to stay inside, which do you believe, the dispatcher was concerned for whose safety, Joe Horn or the two theives? He stood up for his neighbor. If the two clowns didn't break into a home did not run at him, did not stop when confronted by an armed man. The theives made a whole bunch of bad choices against a man who new his rights and the laws of the land. I am not advocating shooting and killing any thief, but when caught and staring down the barrel of a gun especially in Texas, you should just lay down and wait to be arrested. The theives made all of the decisions that lead to their demise.
