Each state's labor boards handle it differently. So let me return to my original direction: Get in contact with the local office of The Department of Labor - Wage and Hour Division. They are a Federal office and don't care if your a 1099 or an employee. IF "X" number of hours are worked and then end paycheck is less than minimum wage, they get involved. They don't care about employer/employee relationship. All they care about is if the worker is making minimum wage.
The state offices can flake out. The Feds have teeth. Just ask Pratt Communications out of California.
