And as said employee was not provided with fresh batteries, said employee can now have a possible law suit against said employer for not ensuring that said employee had proper safety equipment in good working order. Wanna know why ????? OSHA does have rules that cover the providing of ample lighting in any and all work spaces. And guess who's responsibility it is to provide such lighting ? ........I'm waiting.
This is why as an employer you are supposed to carry GL insurance to cover such mishaps.

P.S. state laws cannot supersede federal laws.
