Technically, while he is writing you the ticket, you are under arrest. When you sign the ticket, you are released ror. When you either pay it or fight it, you had your day in court.

They can haul you in for the ticket and write it at the station, but it is much more of a hassle for the officer, so unless there is something really wrong they wont do it. Just like a lineman, cops don't like paperwork either. A ticket is one thing, a full arrest set of it is another thing.

As far as the crazy laws still on the books, there are hundreds of them. Typical of the politicians, they are too lazy to take them off the books. It would require an effort on thier part.
