This is a case of how a bunch of scumbag companies have skipped around the laws for so long it has alot of good people confused on how things really work. There is no such thing in any state or anywhere in the United States as a 1099 Employee. To be 1099 one must provide Insurance and meet a list of Subcontractor or Employee requirements.

If you are an employee you must be taxed. There is the wanting the cake and eating it too going on and companies are trying to skirt matching taxes and paying workers comp. Yet still having total control over you. Look up the case of the Buttery Couple in Virginia Beach doing FTTP for Ivy Smith, they are now doing 18 months in the slammer for not taxing their people. Yet you have an FTTP Prime in Nothern Virginia who is hiring Field Supervisors right now telling them they must go the first 90 days on a 1099 and provide their own transportation on the job site with a fuel per diem. They also make sure you know NOT TO DARE GET HURT ON THE JOBSITE! What a load of crap!
