Get the paperwork started. At anytime you can drop the suite. In fact it is important that once you are paid you have the courts remove any lien and clear the judgment.
Sue for your money + interest + legal fees + collection fees to enforce the judgment.
Use a lawyer and include everybody. If / when they offer to settle make them pay your lawyer & interest.
Threats to sue are ignored. They know what they are doing. You want to get on the list of creditors with judgments.
