The market value is what was paid for the unused duct...Get your materials since you paid for them...The sub is not even entitled to the extra 10,000' footage paid for but not complete with ONE EXCEPTION...If the sub paid for the extra 10,000' of duct that wasn't used...At this point the sub should have the choice of keeping the duct and then your done with them OR...You pay the sub for the unused materials at his cost and maybe a little extra for his troubles...

Now if neither of the above solutions is the case and you already paid him for the extra 10,000' not done then there is no discussion...The remaining materials are all yours and the sub needs to deliver said materials to your storage area OR the sub can reimburse you what you already paid for the materials and then keeps said materials...

Nothing more and nothing less than what I described should be considered acceptable to either side...Have a happy and safe thanksgiving...(nod)
