Do you have any form of documentation signed by that driver acknowledging that he is responsible for any damage to the truck?

Does not matter if he's an employee, contractor, or your buddy. Without any kind of signed documentation spelling out and stating who is responsible for what (prior to an incident).... Then you as the owner are responsible for all lost capital and wages.

Hell ... In some states, even with air-tight paperwork, if that driver is classified as an "employee", the document is useless in court due to that state's Fair Labor Laws.

More details about the owner/worker relationship (i.e. contractor, employee?) ... when was the damage reported? Would help.
