Need a little more background info. Was the driver an employee of the owner? Was the owner in any way profiting from the use of the truck? Most scenarios would put the responsibility on the owner unless there are extenuating circumstances.
It's easy to define what you're willing to fight for; but what are you willing to stand for without fighting? What are you willing to lay down your life for?
