You're misunderstanding the FCC ruling. It only states that all locals have to be on the same dish, not that it has to be on the same dish as regular channels. So, if every local in a market is split across two dishes, that's a problem, but if they are all on one dish but that dish is separate of the 101, that's ok.
72.5 is going away because DirecTV only has a lease on that slot until 9/30/08. DISH has made arrangements with TeleSat, the owner of the 72.5 slot, to lease 16 transponders from that location. The term will start with the launch of a TeleSat-owned satellite to that location in 2009. Coupled with possible operation of a satellite at 77W, DISH will have an all MPEG4 system operating at 61.5, 72.5, and 77, giving them a lot of capacity.
