If you signed the payroll deduction forms and you did not earn enough to pay for the tools, then he should have collected the tools from you upon termination (unless you quit with no notice and failed to handle your separation like a mature adult). However, if the employer still owes you a paycheck, kindly ask him/her to deduct the amount owed from your check. If the employer has not deducted any amount from any of your checks, he can start civil litigation against you. In CA, if you were allowed to take the tools home for work but didn't bring them back, then it is not a criminal matter but a civil one (or so I am told by my local police dept). But if you want to stay in the business, it is best NOT to burn bridges and you should do the right thing. You might have to go back to work for the company some day - you never know.....
