Charter VOIP

In the system I work for, Charter is charging customers for backup batteries for the MTA. Needless to say I have installed 0 batteries since most people aren't willing to pay the $60 or more for a battery. Anyways... I was under the impression that the FCC requires them to provide a backup. How could they get by with this?
