I thought we were talking about individual techs and not companies in general. My above post was for a tech who is considered an employee. Anyone who has federal/state withholdings and receives a W2 is considered an employee regardless of their job title or classification their company puts on them. I'm not sure how the law goes with regards to contractors.

Charge backs between Primes and MSOs are completely different. They would have to be stated some where in the contract or scope of work before being attempted. Like you said, if you are a prime you pretty much have to take what you get if you want to continue being a prime. Just hopefully the techs are treated better by the prime than the prime is by the MSO.
