The way I now understand-----
The 1099 worker, who was an employee, working piece work, and still at the same piece rate, is going to take a pay loss in the end. However the employer who is still sharing the cost of health ins., and reimbursing gas expenses and work expenses and covering Comp ins., will make out much better. The 1099 man is still using company work truck.

SO, in the long run, the 1099 man could file a form SS-8 with the IRS and the employer would be screwed because the IRS would probably determine he was an employee!!
