The only time that you can be a 1099 employee, that I am aware of, is if you actually have a stake in the company and you work there (shareholder, partner, etc).
I am pretty sure that if someone is 1099, and the receive any kind of benefits, gas allowance, etc., they are technically an employee and would have to be reclassified as such.
