Jim Stahl et al v. Mastec North America
This is a collective action brought pursuant to the Fair Labor Standards Act of 1938, as amended, 29 U.S.C. §§ 201 – 219 to recover unpaid minimum wage and overtime compensation owed to satellite service technicians. SSTs who were or have been employed by Mastec, Inc. and Mastec North America, Inc. d/b/a Advance Technologies at any time since July 7, 2002 are eligible to join this case. The lawsuit alleges Mastec has had a policy and practice not to compensate its satellite service technicians with minimum wage or overtime pay for some or all work performed for the benefit of Mastec. The uncompensated work includes sorting, routing and scheduling and/or reporting daily work assignments; attending regularly scheduled mandatory meetings; picking up and loading supplies for installation and repairs; traveling to and from work or from job site to job site or to meetings; service calls during which an installation cannot be completed; uninterrupted lunch breaks of thirty minutes or less; inventory duties; and monitoring calls after-hours. Damages may include unpaid minimum wage, unpaid overtime at one and one-half times the regular rate, an equal additional amount to the unpaid wages in liquidated damages, attorney's fees and costs.
