This is not about stirring up crap. It is the law and if have employees and are not doing this you will be in big trouble and owe alot of money. No one is trying to discourage anyone from working piece rate and making as much as you can. You can structure your pay to conform to the labor law and not discourage anyone from doing as much as they can. The law needs changed as it was written in 1933 and never updated for modern society and skilled workers. The law though until changed needs to be followed and can be followed w/o drastically costing any employer any extra money
