The key here is you have to be an Employee. If you are a sub then you can work as many hours you like and do not fall into OT rules. If however you were or are an employee that is working piece rate production you are by law required to be paid OT for any hours worked over 40 . For example say you do 600.00 production and it takes you 60 hrs to do it . Your hourly rate for that week is 10.00 per ( 600 divided by 60) you are then owed 20 hrs of OT . so that what be another 100.00 for the week. This is the law. Feds go back 2 years on this. If you work or have worked for a company that you were an EMPLOYEE and you worked piece rate and were not paid an OT factor you are owed OT for that period up to 2 years and you will get it if you file a claim. There are many workers out there who do not realize this.
The law was made in 1930s to protect " Rosie the riveter" during war time when they worked piece rates and like so many of our laws has never been updated to fit modern society but it is still the law.
