Right or Wrong on the Subs behalf, If he didnt have proper ins., It becomes the responsibility of the prime, They will be held liable for letting the subs ins. lapse in the first place.
Then again maybe he did have ins., but decided to pay out of the pocket rather than risking screwing his policy up. I khow previous contractors that do this to avoid their rate being jacked up or even cancelled.
