While I am inclined to arrange a meeting between such an offender and their Maker were I to catch any person doing that to a child, I still would defer to hearing an explanation before pulling the trigger.
Granted, were the situation to be extreme i.e. walking in on such an act, here is something to consider.
6p.m.-- Boy Scout troop backpacks in to the wilderness for a weekend camping experience.
8p.m. -- camp set up and chow is made and served.
10p.m. -- everyone hits their tents for down time.
10:30p.m. -- starts to rain.
11:00p.m. -- Scout leader hears one of the boys start to scream and investigates.
He finds a bear has ripped the boys tent up trying to retrieve the twinkies the kid had hidden in his backpack.
The scout leader drives the bear away by banging pots and pans and yelling. Meanwhile, the kid is scared half to death, and has no place to sleep except the with one of the other boys or the scout leader. The scout leader thinks it best to have the boy sleep in one of his peers tents, especially after what he just witnessed with a six week Courtroom TV circus.
11:45p.m.-- No one in camp can sleep because this boy is so traumatized and is hysterical.
12 midnight-- The leader is now cold, wet and extremely aggrevated. He gathers the troop and everyone suggests the kid get in the tent with the leader.
Meanwhile--- The weather situation is getting worse. One of the scouts parents cant sleep because they are experiencing the same weather. Because of security concerns, ALL parents know the exact location of the camping area. Mother prompts Father to go check on their kid. It just so happens it is the Father of the scout that now resides in the leaders tent.
2:00a.m. -- After two grueling hours of driving and marching through the wilderness in the rain, cold and darkness, the father finds the camp and sees his childs tent. He recognized it because it is the one with a Super Ninja Turtle emblazened on the flap.
He opens the flap and doesnt realize the sides ripped, only that his son isnt in the tent.
He immediately goes over to the Scout Leaders tent ( Its the 3 man tent because with a 300lb girth, a 2 man tent just wouldnt do) and lo and behold--- There is his son snuggled up close to the leader, both sleeping soundly.
So--- Does the father shoot him, or does the Scout leader get a fair hearing? Can the father inquire or does he immediately grab the child up and let the courts handle it?
We all know the circumstances, but the dad didnt. Keep that in mind while you ponder the solution.
Lets see where this might take us. While the system sucks, its the one we have that works best. Lately it seems like its working for the wrong side.
