I would have to agree with innovative.
The burden is on the employer. If you didnt sign anything, and are getting work from this person, you are an employee by default. This sounds like a cheap claim, so I would talk to him. however, you may be forced into looking for another job. ( of course, there are laws against retaliation for work comp claims, but that is a different story.)
